Tourify specializes in customizable Sri Lankan tour experiences, providing vehicles with drivers, optional tour guides, and accommodation arrangements. We connect you with destinations and activities while clearly defining our service boundaries.

Please read these Terms of Service carefully before using our platform. By creating an account or booking through Tourify, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

Tourify is a specialized platform for customizable Sri Lankan tour experiences. We combine direct service provision with platform connectivity to deliver comprehensive travel solutions.

1. Acceptance of Terms

By accessing or using the Tourify platform, you agree to:

  • Be bound by these Terms of Service
  • Comply with our Privacy Policy and Cookie Policy
  • Use our services only for lawful purposes
  • Provide accurate and complete information
  • Be responsible for maintaining account security

Age Requirement: You must be at least 18 years old to use our services or have parental/guardian consent if you are between 16-18 years old.

2. Our Services and Platform Role
2.1 Our Direct Services

TOURIFY OWNED SERVICES: We directly provide and are responsible for certain core services essential to your Sri Lankan tour experience.

Tourify owns and operates the following services with full responsibility:

  • Vehicle & Driver Service: We provide well-maintained vehicles with professional, licensed drivers
  • Tour Guide Services: We employ qualified tour guides (when requested)
  • Hotel Arrangements: We book and manage 3-star hotel accommodations with upgrade options
  • Airport Transfers: Free pickup/drop-off within 10km of Bandaranaike International Airport
  • Trip Planning Platform: Customizable 5-14 day tour plans with destination database
2.2 Platform Information Services

INFORMATION & COORDINATION: We provide comprehensive destination information and assist with activity planning, but do not operate tourist attractions or activities themselves.

  • Destination information including entrance fees and requirements
  • Pre-defined tour templates optimized for time and logistics
  • Activity recommendations and booking coordination
  • Entrance ticket information (fees paid directly at venues)
  • Local guidance through our tour guides and drivers
2.3 Service Boundaries & Responsibilities

CLEAR RESPONSIBILITY DIVISION: We take full responsibility for our direct services while clearly defining limitations for third-party activities and venues.

  • • Restaurant quality or food safety
  • • Weather conditions affecting activities
  • • Personal accidents during activities
  • • Entrance fees and ticket prices (subject to change)
  • • Third-party service disruptions
3. User Accounts and Responsibilities
3.1 Account Creation
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One account per person - sharing accounts is prohibited
3.2 Prohibited Activities

You agree not to:

  • Use false or misleading information when booking
  • Make fraudulent bookings or payments
  • Interfere with or disrupt our platform or services
  • Use automated systems (bots) to access our platform
  • Attempt to circumvent our security measures
  • Use our platform for any illegal activities
  • Harass or abuse our staff or service providers
4. Booking Terms and Conditions
4.1 Booking Process
  • All bookings are subject to availability confirmation
  • Prices may change until booking is confirmed and paid
  • You must provide accurate traveler information for all participants
  • Special requirements must be communicated during booking
  • Confirmation emails serve as your booking vouchers
4.2 Tourify Pricing Structure

Per-Vehicle Pricing: We charge per vehicle (not per person), making our tours cost-effective for groups and families.

  • Vehicle Service: Fixed daily rate per vehicle for 5-14 day tours
  • Tour Guide: Optional flat fee if requested
  • Accommodation: Fixed daily rate for 3-star hotels with upgrade options
  • Airport Transfer: Free within 10km of Bandaranaike International Airport
  • Extended Pickup: Additional charge for pickup beyond 10km radius
  • Entrance Fees: Paid directly at venues (we provide cost information)
  • Pre-booked Attractions: Charged upfront only when required
4.3 Booking Timeline and Short Notice Policy

Short Notice Bookings: Tours starting within 1 week are accepted but cannot be guaranteed due to limited preparation time.

  • Advance Booking: Recommended minimum 1 week before travel start date
  • Short Notice Acceptance: We accept bookings within 1 week but show appropriate warnings
  • Processing Risk: Short notice bookings may not be processed in time
  • Full Refund Promise: If we cannot process short notice bookings, full refund is provided
  • No Penalties: No cancellation fees for our processing failures on short notice bookings
4.4 Travel Documentation

Important: You are responsible for ensuring you have valid travel documentation and meet all entry requirements.

  • Valid passport with at least 6 months validity
  • Appropriate visas or entry permits for Sri Lanka
  • Travel insurance (strongly recommended)
  • Vaccination certificates if required
  • Any other documentation required by authorities
5. Payment Terms
5.1 Payment Processing
  • Payments are processed securely through Stripe
  • We accept major credit cards and debit cards
  • Full payment is required at the time of booking
  • We do not store your payment card information
  • Payment confirmation is required for booking confirmation
5.2 Currency and Conversion
  • All transactions are processed in USD
  • Your bank may charge currency conversion fees
  • Exchange rates are determined by your payment provider
  • We are not responsible for currency fluctuation charges
5.3 Failed Payments
  • Bookings are not confirmed until payment is successful
  • You will be notified immediately of payment failures
  • You have 24 hours to complete payment after initial attempt
  • Unpaid bookings may be automatically cancelled
6. Cancellation and Refund Policy
6.1 Tourify Cancellation Policy

CUSTOMER-FRIENDLY POLICY: Tourify provides transparent refunds based on advance notice given before your trip departure date. We process refunds directly through our platform with clear retention fees.

Our cancellation policy is based on the number of days before your trip departure:

Higher Refund Periods
  • 90+ days: 90% refund (10% retention fee)
  • 61-89 days: 75% refund (25% retention fee)
Lower Refund Periods
  • 31-60 days: 50% refund (50% retention fee)
  • 15-30 days: 25% refund (75% retention fee)
  • 0-14 days: No refund (100% retention)
6.2 Emergency Cancellations

COMPASSIONATE POLICY: For genuine emergencies (medical, force majeure, family emergencies), we reduce retention fees to just 5% administrative fee, regardless of timing.

Emergency cancellations include:

  • Medical emergencies (with medical documentation)
  • Natural disasters affecting travel
  • Government travel advisories or restrictions
  • Family emergencies (death, serious illness)
  • Force majeure events beyond customer control

Documentation Required: Emergency cancellations may require supporting documentation and are subject to verification.

6.3 Refund Processing

AUTOMATED PROCESSING: Most cancellations are processed automatically. High-value bookings (over $2,000) or emergency cancellations may require admin review.

  • Processing Time: 5-10 business days for refunds to appear
  • Refund Method: Original payment method via Stripe
  • Currency: Refunded in original payment currency
  • Confirmation: Email notification sent when processed
  • High-Value Review: Bookings over $2,000 require manual review
6.4 Cancellation Restrictions

IMPORTANT LIMITATIONS: Certain situations prevent cancellation or affect refund eligibility.

  • Completed Trips: No cancellations accepted after trip completion
  • Started Trips: No cancellations accepted once the trip has started
  • No-Show: No refunds for failure to show up without notice
  • Policy Changes: Cancellation terms cannot be modified after booking
6.5 Tourify-Initiated Cancellations

FULL REFUND GUARANTEE: If Tourify cancels your booking due to operational issues, you receive a full 100% refund with no retention fees.

  • Operational issues preventing service delivery
  • Vehicle or driver unavailability
  • Safety concerns or travel advisories
  • Force majeure events affecting our operations
  • Alternative arrangements offered when possible
7. Liability Limitations and Disclaimers
7.1 MAXIMUM LIABILITY CAP

STRICT LIABILITY LIMITATION: Under no circumstances shall Tourify's total aggregate liability to you exceed the actual amount you paid to Tourify for the specific booking that gave rise to the claim, and in no event shall such liability exceed USD $1,000.

  • Our liability is strictly limited to platform booking fees only
  • We are NOT liable for the cost of tours, accommodations, or travel services
  • We are NOT liable for any consequential, indirect, or special damages
  • We are NOT liable for lost profits, lost opportunities, or business interruption
  • We are NOT liable for personal injury, death, or property damage
7.2 Service Quality and Reasonable Expectations

QUALITY COMMITMENT: While we strive to provide excellent service and maintain high standards, travel services involve inherent variables beyond our complete control.

We work diligently to ensure quality service delivery, however:

  • Service Standards: We maintain professional standards for our direct services (vehicles, drivers, guides)
  • Platform Reliability: We work to ensure platform uptime and accurate information
  • Third-Party Services: Hotel and attraction quality may vary and is subject to their own standards
  • External Factors: Weather, traffic, and unforeseen circumstances may affect service delivery
  • Continuous Improvement: We regularly review and improve our services based on feedback
  • Issue Resolution: We provide customer support to address concerns and resolve problems

Our Commitment: We are committed to providing professional tour services and will work to resolve any issues that arise during your experience.

7.3 USER ASSUMPTION OF RISK

TRAVEL AT YOUR OWN RISK: You acknowledge that travel involves inherent risks and you voluntarily assume all risks associated with your travel and use of services booked through our platform.

You acknowledge and agree that:

  • You are solely responsible for evaluating service providers and services
  • You must verify all booking details, terms, and conditions independently
  • You are responsible for obtaining appropriate travel insurance
  • You must ensure you have valid travel documents and meet entry requirements
  • You participate in all activities at your own risk and discretion
7.4 INDEMNIFICATION

USER INDEMNIFICATION: You agree to defend, indemnify, and hold harmless Tourify and its officers, directors, employees, and agents from any claims, damages, or losses arising from your use of our platform or services.

This includes but is not limited to claims arising from your conduct, your breach of these terms, your violation of any rights of third parties, or your use of services booked through our platform.

7.5 FORCE MAJEURE AND EXTERNAL FACTORS

We are not liable for any delays, cancellations, or failures caused by events beyond our reasonable control, including:

  • Natural disasters, extreme weather, or environmental conditions
  • Government actions, travel restrictions, visa denials, or policy changes
  • Labor strikes, civil unrest, terrorism, or political instability
  • Pandemic, health emergencies, or quarantine requirements
  • Technical failures, internet outages, or cyber attacks
  • Service provider failures, bankruptcies, or operational issues
  • Currency fluctuations or economic instability
8. Travel Insurance

Strongly Recommended: We highly recommend purchasing comprehensive travel insurance to protect against unforeseen circumstances.

Travel insurance should cover:

  • Trip cancellation and interruption
  • Medical emergencies and evacuation
  • Lost or delayed baggage
  • Flight delays and missed connections
  • Adventure activities and sports coverage
9. Intellectual Property
9.1 Tourify Intellectual Property Rights

© 2025 Tourify Ltd. All platform content, software, databases, tour plans, and proprietary systems are protected by copyright and other intellectual property laws.

Our protected intellectual property includes:

  • Proprietary Software: Booking platform, tour planning algorithms, pricing systems
  • Tour Plan Database: Pre-defined 5-14 day tour templates and destination combinations
  • Brand Assets: "Tourify" name, logos, trademarks, and visual identity
  • Content Database: Destination descriptions, hotel information, activity details
  • Business Methods: Unique tour customization processes and service delivery methods
  • Photography: All photos are owned by Tourify or used with proper licensing
9.2 User Content
  • You retain ownership of content you submit (reviews, photos)
  • You grant us license to use your content for promotional purposes
  • You warrant that your content does not infringe third-party rights
  • We may remove content that violates our policies
10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms of Service.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy and Cookie Policy.

11. Dispute Resolution and Legal Framework
11.1 LIMITED CUSTOMER SUPPORT SCOPE

SUPPORT LIMITATIONS: Our customer support is provided on a best-effort basis only. We make no guarantees regarding response times, resolution success, or outcome satisfaction.

  • Email: support@thetourify.com (best-effort response, no guaranteed timeframe)
  • Support is limited to platform-related technical issues only
  • Service quality issues must be resolved directly with providers
  • We cannot mediate disputes between customers and service providers
  • Support decisions are final and not subject to appeal
  • We reserve the right to limit or discontinue support at any time
11.2 MANDATORY ARBITRATION AND JURISDICTION

BINDING ARBITRATION REQUIRED: By using our services, you agree to resolve all disputes through binding arbitration and waive your right to jury trials or class action participation.

  • All disputes must be resolved through individual binding arbitration
  • You waive all rights to jury trials and class action lawsuits
  • Arbitration proceedings are governed by [Your Jurisdiction] law
  • Arbitration costs are borne entirely by the disputing party (you)
  • Arbitration decisions are final and cannot be appealed
  • Only individual disputes are permitted - no group or consolidated claims
11.3 LEGAL COSTS AND ATTORNEY FEES

COST RESPONSIBILITY: In any legal proceedings, the prevailing party (likely Tourify) is entitled to recover all attorney fees, court costs, and legal expenses from the losing party.

  • You are responsible for all legal costs if you pursue unsuccessful claims
  • We are entitled to recover attorney fees for defending frivolous claims
  • Pre-litigation costs and collection expenses are your responsibility
  • Expert witness fees and discovery costs are borne by the losing party
  • International legal proceedings incur additional cost obligations
11.4 STATUTE OF LIMITATIONS

SHORTENED LIMITATION PERIOD: All claims against Tourify must be filed within 6 months of the incident giving rise to the claim, or be forever barred regardless of normal statutory limitation periods.

  • 6-month limitation period applies to all claims regardless of jurisdiction
  • Time begins running from date of booking, not date of travel
  • Failure to file within 6 months constitutes absolute waiver of all claims
  • This shortened period supersedes local statute of limitations laws
  • No tolling or extension of this period is permitted under any circumstances
11.5 FORUM SELECTION AND INCONVENIENT VENUE

You agree that any legal proceedings must be conducted in our designated jurisdiction, regardless of your location or where services were provided:

  • Exclusive jurisdiction in [Your Local Courts], regardless of where you reside
  • You waive any claims of inconvenient forum or lack of jurisdiction
  • Local laws of [Your Jurisdiction] apply exclusively to all disputes
  • You are responsible for all travel and accommodation costs for legal proceedings
  • No change of venue will be permitted regardless of circumstances
12. Modifications to Terms

We may update these Terms of Service periodically to reflect changes in our services, legal requirements, or business practices. When we make significant changes:

  • We will update the "Last Modified" date
  • Registered users will receive email notification
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, you may close your account
13. Account Termination and Service Discontinuation
13.1 TERMINATION BY YOU - LIMITED RIGHTS

NO REFUND UPON TERMINATION: Account closure does not entitle you to refunds for any services, including unused portions of bookings or platform access fees.

  • Account closure requests may be denied at our discretion
  • Outstanding bookings remain your financial responsibility
  • No refunds for unused services or partial booking values
  • Data retention is determined solely by our policies and legal requirements
  • You remain liable for all outstanding obligations and fees
  • We may continue processing historical transactions after account closure
13.2 TERMINATION BY US - UNRESTRICTED AUTHORITY

UNLIMITED TERMINATION RIGHTS: We reserve the absolute right to suspend, terminate, or restrict your access to our platform at any time, for any reason, or for no reason, without notice or compensation.

We may terminate your account immediately and without warning for:

  • Any violation of these terms, as determined by us in our sole discretion
  • Suspected fraudulent activity or questionable payment practices
  • Negative reviews or complaints about our services
  • Excessive support requests or demands we deem unreasonable
  • Any behavior we consider detrimental to our business interests
  • Business reasons, platform changes, or operational considerations
  • Legal or regulatory requirements, or risk management concerns
  • Any reason we deem appropriate, without explanation required
13.3 CONSEQUENCES OF TERMINATION

NO COMPENSATION FOR TERMINATION: Account termination, whether voluntary or involuntary, results in immediate loss of all platform access and benefits without any compensation or refund obligations.

  • Immediate loss of access to all platform features and booking history
  • No refunds for any bookings, fees, or charges of any kind
  • Outstanding obligations and liabilities remain in full effect
  • We may retain all data indefinitely for business and legal purposes
  • Future booking attempts may be blocked or restricted
  • Legal obligations and indemnification requirements survive termination
13.4 SERVICE DISCONTINUATION RIGHTS

PLATFORM DISCONTINUATION: We reserve the right to discontinue, modify, or restrict any aspect of our services at any time without notice, compensation, or liability to users.

  • We may discontinue the entire platform or specific features without notice
  • No compensation is provided for service interruptions or discontinuation
  • Outstanding bookings may become our sole discretion to honor or cancel
  • We are not liable for any losses caused by service changes or discontinuation
  • Alternative arrangements are provided at our discretion, not as obligation

15. Severability and Entire Agreement
Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tourify regarding your use of our services.
