Terms of Service

These Terms of Service govern your access to and use of thetourify.com and the services provided by Tourify Travel Pty Ltd (ACN 690 308 528). By creating an account or completing a booking you agree to be bound by these terms. If you do not agree, please do not use our platform.
1. Acceptance of terms
You must be at least 18 years old to make a booking. By using the platform you confirm that you have read and accepted these terms, our Privacy Policy, and our Cookie Policy. You also agree to provide accurate information, maintain the security of your account credentials, and use the platform only for lawful purposes.
2. Services we provide
Tourify is a platform for planning and booking private tours in Sri Lanka. Our services include:
- Vehicle & driver: Well-maintained vehicles with professional, licensed drivers for the duration of your tour.
- Tour guides: Qualified guides available as an optional add-on to your booking.
- Accommodation arrangements: Hotel bookings at 3-star and above properties, managed by our team (optional).
- Airport transfers: Free pickup or drop-off within 10 km of Bandaranaike International Airport; additional charges apply beyond that radius.
- Trip planning: Customisable tour plans from our destination library, available for tours of 5–14 days.
Tourify does not operate tourist attractions, restaurants, or third-party activities. Entrance fees are paid by you directly at venues. We provide information on fees but are not responsible for changes to pricing or operating hours.
3. User accounts & responsibilities
3.1 Account
- You must provide accurate registration information.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- Notify us immediately at support@thetourify.com if you suspect unauthorised access.
3.2 Prohibited conduct
You agree not to:
- Provide false or misleading information when booking.
- Make fraudulent bookings or payments.
- Use automated tools or bots to access the platform.
- Attempt to circumvent security measures or interfere with platform operation.
- Use the platform for any unlawful purpose or in a way that harms Tourify, its staff, or other users.
4. Bookings & pricing
4.1 Booking process
- All bookings are subject to availability confirmation.
- Prices shown on the platform may change until your booking is confirmed and the deposit is paid.
- Your booking confirmation email serves as your booking voucher.
- Special requirements must be noted during the booking process; we cannot guarantee arrangements requested after confirmation.
4.2 Pricing
Tourify charges per vehicle, not per person. The tour price covers your vehicle and driver for the full duration. Optional add-ons (guide, accommodation) are itemised separately and shown before you confirm.
4.3 Short-notice bookings
We accept bookings with fewer than 7 days' notice, but cannot guarantee processing within that window. If we are unable to confirm a short-notice booking, a full refund is issued with no fees.
4.4 Travel documents
You are solely responsible for ensuring you hold a valid passport (minimum 6 months validity), the appropriate Sri Lanka visa or Electronic Travel Authorisation (ETA), and any other documentation required by authorities. We strongly recommend comprehensive travel insurance.
5. Payment terms
5.1 Payment processing
Payments are processed by Stripe (PCI-DSS Level 1 certified). We accept Visa, Mastercard, and American Express. All transactions are in USD. Your bank may charge currency conversion fees — we are not responsible for those charges.
5.2 Deposit & full-payment discount
- A 10% deposit is required at the time of booking to confirm your reservation.
- Paying the full amount upfront earns a 3% discount on your total booking value.
5.3 Instalment schedule
Payment plans are available when you book 30 or more days before departure. The number of instalments depends on your lead time:
- 120+ days before trip
- Up to 4 instalments.
- 75–119 days before trip
- Up to 3 instalments.
- 45–74 days before trip
- Up to 2 instalments.
- 30–44 days before trip
- 1 instalment (balance paid in full).
- Under 30 days before trip
- Full payment required at booking.
- Final payment deadline
- All outstanding balances must be paid at least 14 days before your trip start date.
5.4 Failed payments
- Your booking is not confirmed until the deposit payment succeeds.
- You will be notified immediately of any failed payment and have 24 hours to retry.
- Missing an instalment deadline may result in automatic cancellation, subject to our cancellation policy below.
6. Cancellation & refunds
6.1 Customer cancellations
Cancellation is free until 30 days before your trip departure — you receive a 100% refund, including your deposit. After that, refunds are calculated based on how many days before departure you cancel:
- 30+ days before departure
- 100% refund, including your deposit.
- 15–29 days
- 50% refund (50% retention fee).
- 0–14 days
- No cash refund. You may apply what you have paid as credit toward a future trip — contact our support team to arrange this.
- No-show
- No refund.
- Trip in progress
- No cancellations accepted.
If you are on a payment plan, the retention fee is calculated on the total trip price. We refund what you have already paid, less the applicable retention fee (never below zero), and all remaining instalments are cancelled — you will not be charged further after cancelling.
6.2 Date changes
You can reschedule your trip free of charge up to 30 days before departure, subject to availability. Within 30 days of departure, date changes are treated as a cancellation and rebooking under the policy above.
6.3 Emergency situations
The refund tiers above apply regardless of the reason for cancellation. In cases of genuine emergency, we may at our sole discretion offer a more favourable outcome on a case-by-case basis — contact our support team. We strongly recommend travel insurance for unexpected events (see §8).
6.4 Refund processing
- Refunds are returned to your original payment method via Stripe within 5–10 business days.
- You will receive an email confirmation when processed.
- Bookings over USD 2,000 may require manual review before the refund is issued.
6.5 Tourify-initiated cancellations
If Tourify cancels your booking due to operational issues, vehicle unavailability, or safety concerns, you will receive a full 100% refund. We will offer alternative arrangements where possible.
7. Liability & disclaimers
7.1 Our liability
To the extent permitted by law (including the Australian Consumer Law), our total liability for any claim arising from these terms or your use of our services is limited to the amount you paid for the specific booking that gave rise to the claim. We are not liable for consequential, indirect, punitive, or special losses.
Nothing in these terms excludes or limits rights you may have under the Australian Consumer Law, including non-excludable consumer guarantees.
7.2 What we are not responsible for
- The operations, quality, or safety of tourist attractions, restaurants, or third-party activities.
- Weather conditions, road closures, or other circumstances beyond our control that affect your itinerary.
- Personal injury or property damage during activities at third-party venues.
- Changes to entrance fees, operating hours, or availability at any attraction.
7.3 Force majeure
We are not liable for delays, cancellations, or failures caused by events beyond our reasonable control, including natural disasters, government travel restrictions, civil unrest, pandemic or public health emergencies, or infrastructure failures. In these circumstances we will offer rescheduling or alternative arrangements where possible.
8. Travel insurance
We strongly recommend that all travellers purchase comprehensive travel insurance before departure, covering trip cancellation, medical emergencies and evacuation, lost baggage, and flight delays. Tourify does not provide travel insurance.
9. Intellectual property
All content, software, tour plan databases, brand assets, and platform designs are the property of Tourify Travel Pty Ltd or used with appropriate licences. You may not reproduce, distribute, or create derivative works from any platform content without our written permission.
You retain ownership of any reviews or content you submit to the platform. By submitting content you grant us a non-exclusive licence to use it for platform and promotional purposes, and warrant that it does not infringe third-party rights.
10. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms. Please read it carefully before using the platform.
11. Changes to these terms
We may update these terms periodically. When we make material changes we will update the "Last updated" date and notify registered users by email. Continued use of the platform after notification constitutes acceptance, subject to your rights under applicable law. If you disagree with the changes, you may close your account before they take effect.
12. Account termination
You may close your account at any time by contacting us. Any confirmed bookings remain subject to the cancellation policy in §6.
We may suspend or terminate your account if you breach these terms, engage in fraudulent activity, or if required by law. Where we terminate for our own operational reasons, confirmed bookings will be honoured or refunded in full.
13. Governing law & disputes
These terms are governed by the laws of Victoria, Australia. We aim to resolve any dispute informally — please contact us at legal@thetourify.com and we will respond within 5 business days. If a dispute cannot be resolved by email, the courts of Victoria, Australia have non-exclusive jurisdiction.
14. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tourify Travel Pty Ltd regarding your use of our services.
